Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

Who We Are

All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography.Examples of unacceptable material:

  • IRC Bots
  • Warez Sites
  • Pirated Software
  • Hate sites
  • Hack Programs and archives

Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double optin” will be treated as spam. Any user who sends out spam will have their account terminated without notice. We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion. We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Tricasol.com. Information Use

Personal Information. The information we collect is used for billing and to provide service and support to our customers. We may study this information to determine our customers needs and to promote certain products and services or additional support. We may also generate non-identifying and aggregate profiles from information that our customers provide during registration (such as the total number of customers in a given category). This aggregated and non-identifying information may be used to promote advertisements that appear on our website and in connection with our services. We take reasonable precautions to prevent unauthorised access to your information. Accordingly, we may require you to provide additional forms of identity should you wish to obtain information about your account details. CRICVO may also use the information you provide to email CRICVO's monthly newsletter to the primary contact e-mail on file, or to contact you about other products or services that we think may be of interest. Log Files. We use IP addresses to analyse trends, administer our site and servers, track access, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. However, it is possible that personal information about a customer may be included in the log files due to the normal functions of IP addresses and Web browsing. Customer Surveys We may use the contact and other information provided to follow up with customers who respond to our customer surveys to help resolve issues internally or with our third party partners. For example, CRICVO may contact customers based on their survey answers or to highlight certain changes we made in response to customer feedback.

Payment Information

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify Tricasol.com of your desire to cancel any or all services received, those services will be billed on a recurring basis. We reserve the right to change the monthly payment amount and any other charges at anytime.

Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

Cancellation and Refunds

We reserve the right to cancel any account at any time. Customers may also cancel their account at any time. We give you a conditional money back guarantee on managed shared hosting, and reseller solutions. Refund requests after 30 days will be refunded on a prorated basis of any unused time. Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. Accounts involved in spamming, spoofing or any such activities won’t be provided with any refund at all. Dedicated servers, VPS, domain names and all other services won’t be refunded at all.

Resource Usage

Users may not initiate the following:

  1. Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
  2. Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
  3. Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  4. Run any software that interfaces with an IRC (Internet Relay Chat) network.
  5. Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

Reseller Relationships

In addition to all of the terms and conditions set forth above, the following terms apply to Reseller relationships only. Information Related to Data Collected through Resellers. CRICVO may collect information under the direction of our Resellers, and we have no direct relationship with the individuals whose personal data is provided, processed or obtained by our Resellers. Customers who seek access, or who seek to correct, amend, or delete inaccurate data should direct their query to the Reseller’s data controller. If the Reseller requests that we remove the data, we will respond to such request within thirty (30) business days. Choice. If you are a customer of one of our Resellers and would no longer like to be contacted by such Reseller, please contact the Reseller from whom you purchased products or services. Data Retention. We retain personal data we process on behalf of our Resellers for as long as needed to provide services under the relationship. We will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Money back Guarantee

On dedicated servers, and colocation no full refund will be honored, the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all.

Price Charge

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on our site, and the right to increase the amount of resources given to plans at any time.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Tricasol.com’s server.We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

Changes to the TOS

We reserve the right to revise its policies at any time without notice.

Premium Domain Registries

If a name you’re looking for happens to be premium, the search results will indicate as much, and show the actual price for the domain name.

Registry-sold premium domains may be of two types –

Some domains may be sold at a very high initial price but will renew or transfer at the same price as a regular domain name. Other domains may be sold at a higher price, but will also renew or transfer at the same higher price.

However, you understand that the Company does not control all aspects of the domain registration process. For example, once you submit a domain registration, the Company forwards the information contained in the registration to the appropriate Registry Administrator for processing and actual registration of the name.

Also, as consideration for the domain registration service provided by the company, you agree to pay the company, prior to the effectiveness of the desired domain registration. Keeping in mind, once the company confirms the payment and starts registration process, ICAAN holds the authority to put the amendments at any stage of order processing, therefore the company will not be held liable for any inaccuracies.
